1.Brand Relationship Disclosure
Thirsty Fin is a brand and trade name operated by Classic Consoles LLC. Although the Thirsty Fin website may appear as a distinct brand experience, all products sold through https://Thirsty-Fin.com are offered by Classic Consoles LLC, and all transactions, payment processing, customer data collection, and fulfillment are handled by Classic Consoles LLC using a shared e-commerce platform.
2.Sales Tax Collection
Classic Consoles collects and remits sales tax only in states where it has established sales-tax nexus under applicable law. Sales-tax rates are calculated at checkout based on your shipping address using a third-party service provider (Avalara). Applicable sales tax will be added to your order total at checkout.
Classic Consoles uses Avalara’s default product tax classification (P0000000) for sales-tax determination. Taxability may vary by jurisdiction.
3.Pricing and Orders
All prices are shown in U.S. dollars. Prices do not include shipping or handling unless stated otherwise. We reserve the right to change pricing, availability, or discontinue products at any time.
4.Returns
Products may be returned within 30 days of delivery subject to Classic Consoles’s return and restocking policies. An RMA is required prior to return.
5.Warranty Disclaimer and Limitation of Liability
Products are provided subject to Classic Consoles’s limited warranty. To the fullest extent permitted by law, Classic Consoles disclaims all implied warranties and limits its liability for indirect, incidental, or consequential damages. Classic Consoles’s total aggregate liability to you, regardless of the cause of action, shall not exceed the purchase price you paid for the specific product giving rise to the claim. Classic Consoles makes no representation that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.
6.Intellectual Property
All Website content, including content associated with the Thirsty Fin brand, is owned by Classic Consoles LLC and protected by U.S. and international intellectual-property laws.
7.Governing Law; Dispute Resolution; Venue
These Terms are governed by Georgia law. Any dispute arising under or related to these Terms shall be resolved by binding arbitration through the American Arbitration Association pursuant to its then-current rules. The prevailing party in any such arbitration or litigation shall be entitled to recover its reasonable attorney fees and costs from the non-prevailing party. Venue for any litigation shall be exclusively in Grady County, Georgia.
8.Privacy
Classic Consoles collects and processes personal information in connection with your use of the Website and your purchases. By using the Website, you acknowledge and agree to Classic Consoles’s Privacy Policy, which is incorporated by reference and available at https://ClassicConsoles.com/privacy. Classic Consoles does not sell your personal information to third parties. 10.Order Acceptance and Payment
Your order constitutes an offer to purchase. Classic Consoles reserves the right to accept or decline any order at its sole discretion, including after an order confirmation has been sent. All payments are processed by Classic Consoles’s third-party payment processor. Classic Consoles does not store full credit card numbers. In the event of a payment dispute or chargeback, Classic Consoles reserves the right to suspend or terminate your access to the Website and to seek recovery of amounts owed.
11.Shipping; Risk of Loss
Classic Consoles ships products to the address you provide at checkout. Shipping estimates are not guaranteed delivery dates. Risk of loss and title for products pass to you upon delivery to the carrier. Classic Consoles is not responsible for delays caused by the carrier, customs, or events outside its control.
12.Indemnification
